Terms of Service

1. Agreement to Terms
By accessing or using the Nahook platform ("Service"), operated by Nahook ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Nahook provides a webhook delivery infrastructure platform that enables customers to send, route, and manage webhook events to their subscribers. The Service includes API access, dashboard, developer portal, SDKs, and related documentation.
3. Accounts and Registration
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials, including API keys and management tokens. You must notify us immediately of any unauthorized access.
You are responsible for all activity that occurs under your account, whether or not authorized by you.
4. Subscription Plans and Billing
The Service is offered under subscription plans with defined usage limits including delivery volume, endpoint count, seats, and rate limits. Plan details and pricing are available on our website.
- Free tier: Subject to usage limits. No credit card required. We may suspend or terminate free accounts that are inactive for 90 or more consecutive days.
- Paid plans: Billed monthly in advance. Subscriptions auto-renew unless cancelled before the next billing cycle.
- Overage: Paid plans that exceed their included delivery volume will be charged overage fees at the rate specified in the plan. Overage is billed monthly in arrears.
- Enterprise: Custom pricing and terms are available by contacting us.
We may change pricing with 30 days' prior notice. Continued use after a price change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit malicious code, malware, or any harmful content through webhook payloads
- Attempt to gain unauthorized access to the Service or its infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for unsolicited bulk messaging or spam
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service without prior written consent
- Use the Service to benchmark or build a competing product
6. Intellectual Property
The Service, including its software, APIs, documentation, and branding, is the exclusive property of Nahook and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
You retain all rights to the data you transmit through the Service ("Customer Data"). You grant us a limited, non-exclusive license to process Customer Data solely to provide and improve the Service.
7. Data Handling
We process Customer Data, including webhook payloads, in accordance with our Privacy Policy. Webhook payload data is stored temporarily for retry and delivery purposes and is not used for any other purpose.
You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining any necessary consents from your end users.
8. Service Availability
We use commercially reasonable efforts to maintain high availability of the Service. However, the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.
We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime resulting from circumstances beyond our reasonable control, including third-party service outages, network failures, or force majeure events.
9. Suspension
We may suspend your access to the Service immediately if:
- You breach these Terms or the Acceptable Use policy
- Your payment is overdue by more than 30 days
- Your use poses a security risk to the Service or other customers
- Required by law or regulatory authority
We will make reasonable efforts to notify you before or promptly after any suspension.
10. Termination
You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period.
Either party may terminate for material breach if the breach is not cured within 30 days of written notice. We may terminate free accounts at any time with 7 days' notice.
Upon termination, your access to the Service and all associated data will be removed. We may retain anonymized and aggregated data for analytical purposes.
11. Limitation of Liability
To the maximum extent permitted by law:
- Our total aggregate liability arising from or related to these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- We are not liable for the content of webhook payloads transmitted through the Service or for any actions taken by your subscribers based on delivered webhooks.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
13. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes at least 7 days before they take effect by email or through the Service. Continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Spain.
